Abans de l\u2019escriptura notarial se sol signar un contracte privat entre el comprador i el venedor que ha de contenir dades importants que condicionen que la transacci\u00f3 finalitzi satisfact\u00f2riament. <\/p><p>Aix\u00ed, haurem de comprovar no nom\u00e9s que aquest primer contracte s\u2019ha redactat i signat correctament, sin\u00f3 que tamb\u00e9 contempla tots els requisits previs necessaris perqu\u00e8 aix\u00f2 sigui aix\u00ed. Ens referim al fet que, abans de signar un contracte, hem de comprovar, entre altres q\u00fcestions, les seg\u00fcents: <\/p><ul><li>L\u2019<strong>estat de c\u00e0rregues de l\u2019habitatge<\/strong> (si t\u00e9 embargaments pendents, si t\u00e9 una hipoteca pendent, etc.).<\/li><li><strong>Quota de la comunitat de propietaris<\/strong> (si est\u00e0 al corrent de pagament amb la comunitat, ja que, si no ho est\u00e0 i comprem, podr\u00edem haver d\u2019assumir nosaltres el deute, etc.).<\/li><li><strong>Arres<\/strong>, es tracta d\u2019un document previ en qu\u00e8 es lliura un import a compte del preu final de la compra d\u2019un immoble. Solen pactar-se les anomenades<em> arres penitencials,<\/em> que suposen que, si \u00e9s el comprador qui anul\u00b7la l\u2019acord, perdr\u00e0 la quantitat lliurada, mentre que, si ho fa el venedor, haur\u00e0 de retornar el doble del que ha rebut. <\/li><li><strong>Despeses de compravenda,<\/strong> si les parts no pacten res, o si indiquen en el contracte que sigui <em>\u201csegons la llei\u201d<\/em>, s\u2019aplicar\u00e0 la legislaci\u00f3 de la comunitat aut\u00f2noma competent.
